What Are the Job Duties Of Banking Attorneys?

Introduction

Banking Attorneys work in financial (banking) institution which can be called their clients. They are saddled with the responsibility to help their clients on matters that have to do with their banking/financial ones. These may be but not limited to assisting the institution to recover debts from customers, restructuring the entire institution business processes and many more. Financial attorney must be a professional who has completed his or her studies at reputable law school that has been approved by the National Bar Association of the country where the law school is situated.

The education process of a would-be financial or banking attorney starts with a first degree in relevant discipline (or law). He will now proceed after graduating to a three year studies in the law school which he has to write Law school Admission Test (LSAT) before getting admission. After matriculation, the national bar association accredited student will do one year general practice courses before specializing in one of the finance and banking courses. After graduation from Law school, a Juries doctor (J.D) is awarded and such graduate can start work immediately he passes the state’s bar examination.

While banking and financial laws can be categorized into many practices, notable of them are real estate finance, private equity banking, banking project finance and a host of others. An Attorney in a bank will need to specialize in any of these areas while he takes the others as sub-practices. Or, he or she may have basic knowledge on all the sub-practices. Generally, banking or financial attorney will have an office although he may have to be travelling out to see clients at all the times.

Following are some of the duties of banking or financial attorneys.

Meeting the clients

The Finance or banking attorneys usually go out of their office to meet their employee’s clients in a situation where new case affects those clients. They need to meet the clients and understand their own parts of story with regard to the case. In another vein, such attorney may even meet his employee and solicit on how new business, product or solution can be properly setup with emphasis on legal aspect of the solution or business.

Assisting clients/employee

Besides soliciting for new business or products, banking attorneys also have duties to get all necessary documents that will facilitate the proper take off of new products. And in case of clients’, they will need to assist them in getting all appropriate documentations which may include credit card numbers, bank account numbers, tax identification numbers and a host of others. It is the attorneys’ responsibility to ensure all contract agreements go well without any legal issue making sure that every aspect is covered.

Represent Clients

One of finance or banking attorneys’ duties is to represent their clients or employee in the court of law for any case that may involve the clients. They are expected to cross-examine the witness to the case, question or interrogate expert lawyers on matters that affect the clients, provide evidence to support the case and concluding the case by making closing arguments.
